I understand that through my enrollment of myself or (a) minor(s) in programming with Hyde Park Chinese School (“HPCS” of “the School”), I certify that I am a legal adult with the authority to agree to the terms outlined in this waiver on behalf of myself or any children I enroll. I understand that by submitting any registration in HPCS programming for myself or anyone else, I am signifying my agreement with this severable and legally-binding waiver.
Use of Facilities Agreement
HPCS uses the classroom of Cobb Hall of the University of Chicago (“host organization”). We ask your assistance in using this facility responsibly and safely by following these rules:
● Students should arrive no earlier than 15 minutes before the start of their class. Neither the School nor the host organization are responsible for monitoring students outside of the building.
● The School’s use is restricted to the classrooms and designated waiting areas and washroom facilities. Students and their families should not enter other areas of the building. Neither the School or host organization are responsible for monitoring students outside of the designated areas.
● Children under 7 years must be accompanied into and out of the classroom's waiting room areas by an adult or older sibling.
● Visitors are not permitted inside of the classrooms during class time unless they are HPCS staff working in a professional capacity or designated volunteers for specific events. Visitors outside of these parameters are permitted solely at the discretion of the instructor.
● Students are encouraged to wait inside for rides and discouraged from getting picked up at the curb for safety reasons. Neither the School nor host organization are responsible for children left unattended outside their facilities.
● Please treat the facility and host organization with respect by passing through the building quietly.
Students’ belongings should be neatly placed on or under a chair or in a cubby at their respective classroom location. Belongings should be kept off of floors and stairs. Hyde Park Chinese School is not responsible for missing or lost items.
I take full responsibility for my own behavior and that of my child. I also assume full responsibility for any damage my child and/or I may cause to the facilities utilized by HPCS.
Authorization to Seek Medical Attention
In the event of an accident, injury, or severe illness, when parent, legal guardian or emergency contact are not available, I give permission to HPCS to procure medical attention.
Acknowledgement of Payment Terms & Conditions and Refund Policy
● I understand that registration will not be processed without payment.
● I understand that by enrolling in monthly payment series or program classes or by selecting the optional payment plan for tuition, I am entering into a payment contract, wherein I will be obligated to pay the first tuition installment and a fee (payment plan and/or registration), and to make subsequent payments of the appropriate amount by the scheduled due dates listed. I understand that I must pay the full amount due even if all classes are not attended, and that failure to fulfill the payment contract will lead to penalties, including late fees, exclusion from performances, revocation of scholarship aid, or dismissal from the School. The School reserves the right to take action to collect any balances due, including turning delinquent accounts over to a collection agency.
● I authorize HPCS to charge my card on file for all payments, including all forthcoming payment plan installments if I do not elect to pay in full.
Tuition will not be pro-rated or refunded because of excessive non-medical absences.
● I understand that any enrollment changes, including class drops, must be submitted in writing to hpchineseschool@gmail.com to get a partial refund. The School reserves the right to charge a $20 restocking/processing fee for non-medical registration changes made to enrollment.
● I understand and agree to the terms of the refund policy, which states that monthly payments and registration fees are non-refundable.
For full-semester classes, No refunds, make-up classes or class credit will be granted if students are absent for less than 1/3 of the full-session classes. If students are absent for more than 1/3 of the full-session classes, 50% of tuition towards the absence will be refunded.
For beginner teen and adult short session enrollment, no refunds will be granted after the first occurrence of the class. If payment is made in full for the session and a student must withdraw after the second class occurrence , tuition may be credited against future registration. Absences do not constitute withdrawal.
● HPCS reserves the right to cancel class when the weather conditions are hazardous. Due to the limited time and amount of space, canceled classes will not be rescheduled or refunded.
I understand that HPCS reserves the right to cancel a class for the remainder of a session due to low enrollment or scheduling issues. In the event of class cancellation, HPSD will find an alternative class and the class change will not be subject to any fees. If a sufficient alternative is not available, HPCS will offer a tuition refund or credit for the amount of tuition paid for any remaining classes.
If a student or an entire class must transition to virtual learning either due to personal circumstances, a shelter-in-place order, or other infectious disease related circumstances, the transition to virtual does not constitute class cancellation.
Photo Release
● I grant permission to HPCS to take photographs or video of myself or my child for rehearsal or promotional purposes of the School, including but not limited to use in printed publications such as brochures and newsletters, as well as website, social media, email, or other electronic forms. I understand that there is no opt-out option, and that participation in HPCS’s programs is contingent upon my compliance with this release.
● I understand that HPCS has designated periods where family and friends of students may take photos and videos of classes, rehearsals, and performances for personal use only and that this media may be posted and shared on personal social media pages. These designated periods will be posted in advance to current students via email, on the HPCS website, and on studio bulletin boards. Participants who are uncomfortable with the prospect of potential social media posting may opt out of the event with the understanding that it may affect their general participation in a class or performance.
● I understand that video dissemination by non-HPSD authorized personnel of HPCS classes, rehearsals, or performances, whether through live streaming or video production, is strictly prohibited.
Assumption of Risk and Release of Liability
I agree to release, indemnify, and hold harmless HPCS, including its teachers, administrators, staff members, Board of Directors, dancers, officers, directors, managers, employees, and other representatives, from any liability, damages, causes of action, claims, or demands, now and in the future, that may arise as a result of my/my child’s participation in HPCS programs. This includes, but is not limited to, exposure to or infection with a communicable disease, personal injuries, death, or property damage or losses, whether caused in whole or in part by HPCS. I understand that this waiver means I give up my right to bring any claims, including for negligence, and agree to waive any claim I may have to seek damages, whether known or unknown, foreseen or unforeseen. I understand and agree that the law of the State of Illinois will apply to this waiver. I have carefully read and fully understand all provisions of this release, and freely and knowingly assume the risk and waive my rights concerning liability as described above.
